1. General Terms

These Terms of Use (“Terms”) govern your access to and use of the services available for users of Mundo Wallet (the “Services”), a decentralized application provided by Oikoumene Digital Corp. (“”Mundo”, ””we”, “us” or “our”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are prohibited from accessing or using the Service.

Before using our Services, please read these Terms carefully, along with any other policies or notices in mobile applications. Our Terms constitute a binding agreement with you, the user of our Services.

2. Mundo Wallet

Mundo Wallet is a decentralized wallet application that enables users to manage digital assets and interact with decentralized applications (“dApps”). The Service is under active development and may evolve or expand with additional features over time.

3. Acceptance of Terms

By accessing or using any or all of the Services, you expressly acknowledge that (i) you have read and understood these Terms; (ii) you agree to be bound by these Terms; and (iii) you are legally competent to enter into these Terms. If you do not agree to be bound by these Terms or any updates or modifications to these Terms, you may not access or use our Services.

4. Limitations

WE DO NOT PROVIDE INVESTMENT OR FINANCIAL ADVICE OR CONSULTING SERVICES. WE ARE SOLELY THE PROVIDER OF THE SOFTWARE (MUNDAO WALLET ) AND WE DO NOT ADVISE OR MAKE RECOMMENDATIONS ABOUT ENGAGING IN DIGITAL ASSET TRANSACTIONS OR OPERATIONS. DECISIONS TO ENGAGE IN TRANSACTIONS OR PERFORM OPERATIONS INVOLVING DIGITAL ASSETS SHOULD BE TAKEN ON YOUR OWN ACCORD. Any actions related to dealing with cryptocurrencies and obtaining benefit out of it shall be your sole responsibility and risk, we may only provide software instruments for such activity, but we neither advise nor incentivize you to use them.

You alone assume the sole responsibility of evaluating the merits and risks associated with the use of the Services, Mundo Wallet, or any related service before making any decisions based on market information or content. In exchange for using the the Services, you agree not to hold Mundo, its agents liable for any possible claim for damages arising from any decision you make based on information made available to you through the Services.

5. Modification

Mundo may change or modify these Terms, the Services and/or any conditions on which we provide the Services to you at any time, without notice. Your continued use of the Services after any modification of the Terms will conclusively indicate that you have acknowledged and fully accepted those changes, and agree to be bound by the latest publicly available version of the Terms. Mundo will use its best efforts to not materially reduce or eliminate any of the core functionalities of the Services during normal operations, unless for scheduled maintenance or if we notify you by sending you an e-mail to the last e mail address you provided to us (if any), through push notifications or any other contact data provided.

6. Eligibility

In order to be eligible to use Mundo Wallet you must: (i) be at least eighteen (18) years old; (ii) be legally competent to enter into transactions; (iii) not be a resident of sanctioned jurisdictions according to any trade embargoes; (iv) not be subject to any economic sanctions according to the United Nations Security Council Sanctions List, the list of specially designated nationals maintained by OFAC, the denied persons or entity list of the U.S. Department of Commerce or any similar list maintained by any other relevant sanctions authority in the jurisdiction of you residence and/or citizenship; (v) not act on behalf of the legal entity which is included in the abovementioned sanctions lists.

You must not use Mundo Wallet if according to the laws of the jurisdiction of your current location/residence, the use of such kind of services is not allowed and will be regarded as illegal. By accepting these Terms and using Mundo Wallet, you warrant that you are only using our Services with the funds that rightfully belong to you and were obtained on the basis of valid legal transactions (not fictitious/pretended). We may still refuse You in provision of our Services either on the basis of our own analysis or upon request of relevant authorities.

7. Ownership and control

You own and control your private key(s) and are solely responsible for safeguarding them. We are not responsible for any loss or theft of your private key(s) or any funds stored in your wallet.

Mundo does not provide any custodial services – the  wallet is decentralized, and we have no ability to control your wallet, funds or private keys. Any services that have a custodial nature that may be made available to you in the Mundo Wallet applications will be provided only by third-party providers. In such a case, you will need to agree to the separate terms of use of these third-party providers and undergo all AML/KYC procedures as may be required for such actions (currency exchange, crypto to fiat exchanges etc.). We are not responsible for any third-party links, services or content that may be accessed through Mundo Wallet.

8. Risks

You understand and acknowledge that DeFi protocols and associated smart contracts are subject to inherent risks and that you use Mundo Wallet at your own risk. You shall, therefore, carefully consider whether the use of Mundo Wallet is suitable for you in light of your circumstances and financial resources.

You also acknowledge that Mundo is not liable for the defamatory, offensive, or illegal conduct of other users, and that you alone are assuming the risk of injury from the foregoing, to the fullest extent of the law. In no event will Mundo, its affiliates, any of their advisers, directors, contractors, or licensors or any other person or entity involved in creating, producing or providing the services, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the services. In addition to these Terms, neither Mundo, nor its affiliates, agents, advisers, information providers, content partners, or third party providers, shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within the services, or for any delay or interruption in the transmission thereof to you, or for any claims or losses arising therefrom or occasioned thereby.

Mundo shall not be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages.

9. No investment advice and forbidden user

We do not provide investment advice.

You may not use Mundo Wallet for any illegal, fraudulent, or otherwise prohibited activities. In case if the team of Mundo Wallet learns about illegal nature of activities for which our Service is used, we reserve the right to refuse you in further provision of the Service. The list of such prohibited activities includes but is not limited to: unlawful activity, fraud, intellectual property infringement, abusive activity, abusive actions against others, etc.

10. Disclaimer of warranties

Mundo Wallet is provided on an “as is” and “as available” basis, and we make no warranties or representations of any kind, whether express or implied, including without limitation, any warranties of merchantability, fitness for a particular purpose, or non-infringement. Entire Agreement: These Terms are the entire agreement between you and Mundo relating to the Service and supersede all prior or contemporaneous oral or written communications, proposals and representations with respect to the Service or any other subject matter covered by these Terms. If any provision of these Terms is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect.

Headings: The headings contained in these Terms are for reference purposes only and shall not affect the meaning or interpretation of these Terms.

11. Limitation of liability

We shall not be liable for any damages of any kind arising out of or in connection with your use of Mundo Wallet, including without limitation, any direct, indirect, incidental, punitive, or consequential damages, except for cases of gross negligence or willful recklessness on our part.

You shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such use of the Services. The foregoing provisions of this section are for the benefit of Mundo, its subsidiaries, affiliates, and agents (which term includes but is not limited to Mundo’s third-party service and content providers) and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

12. Indemnification

To the fullest extent permitted under applicable law, you agree to indemnify and hold Mundo, its partners and affiliates, and each of their council members, advisers, agents and contractors, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with your electronic communications, your own content, your use of the Services, your conduct in connection with the Services or with other users of the Services, your investment in any fund or other opportunity through the Services, or any violation of these Terms or of any law, or the rights of any third part.

13. Governing law

These Terms of use shall be governed by and construed in accordance with the laws of Panama without giving effect to any principles of conflicts of law. You acknowledge and agree to comply with any and all applicable laws and regulations which are relevant to sphere of using the Service.

14. Representations and warranties

You represent and warrant that any information you provide via Mundo Wallet is accurate and complete. You accept and acknowledge that we are not responsible for any errors or omissions that you make in connection with any digital asset transaction initiated via Mundo Wallet. We strongly encourage you to review your transaction details carefully before attempting to transfer a digital asset.

15. Network fees

You must ensure that you have an adequate balance in your wallet to complete transactions before initiating a transaction. We shall not be liable for any failed transactions due to insufficient funds in your wallet or network fees associated with your transaction using Mundo Wallet.

16. Taxes

You understand and are fully aware that using the Service performed may have certain tax and legal implications and You take full liability for any tax or legal consequences that might arise from transactions pertaining to your assets. It is your sole responsibility for paying any taxes applicable to you in relation to using Mundo Wallet. Mundo does not and cannot advise you on the tax consequences of your use of Mundo Wallet. Mundo makes no representations in relation to tax liabilities. We also assume no responsibility for your tax liability or for collecting, reporting, withholding or remitting any taxes arising from Mundo Wallet that you may use. In case We are obliged under applicable law or voluntarily decide to report to any government authorities any information that is related to your tax obligations, you undertake to provide us with the requested documents, data and information.

17. Security

You are responsible for ensuring that your mobile device is secure. Do not use Mundo Wallet on a device that has been “jailbroken”, “cracked”, “rooted” or otherwise had restrictions in the software removed, as this may compromise the security of wallet and your cryptoassets.

18. Amendments

Mundo may amend or modify these Terms by posting them in the MundoApp or otherwise delivering to you the revised Terms, and your continued use of Mundo Wallet constitutes your acceptance of any such amendments or modifications. If you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of Mundo Wallet.You agree that Mundoshall not be liable to you or any third party for any modification or termination of Mundo Wallet, or suspension or termination of your access to Mundo Wallet, except to the extent otherwise expressly set forth herein.

19. Force majeure

We will not be liable for delays in performance or for non-performance due to unforeseen circumstances or causes beyond Our reasonable control. You furthermore agree and understand that in the event of a market disruption, We may, in Our sole discretion, do one or more of the following: (i) suspend access to Mundo Wallet; or (ii) prevent You from completing any actions via Mundo Wallet. We are not liable for any losses suffered by You resulting from such actions.

20. No-Waiver

The failure of Mundo to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in that or any other instance.

21. Severability 

If any provision of these Terms shall be determined to be invalid or unenforceable under any rule, law, or regulation of any local, state, or federal government agency, such provision will be changed and interpreted to accomplish the objectives of the provision to the greatest extent possible under any applicable law and the validity or enforceability of any other provision of these Terms shall not be affected. If such construction is not possible, the invalid or unenforceable portion will be severed from these Terms but the rest of the Terms will remain in full force and effect.
